Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Raihan Software LLC ("Company," "we," "us," or "our") concerning your access to and use of the FacturMe platform available at app.factur.me (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Service Description

FacturMe is a Software as a Service (SaaS) platform that provides time tracking, invoicing, client management, and related business management tools for freelancers and small businesses.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account. Accounts registered by automated means are not permitted.

Subscription and Billing

Free Trial

We offer a 7-day free trial for new users. No credit card is required to start your trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

Paid Subscriptions

By subscribing to a paid plan, you agree to pay the subscription fees as displayed at the time of purchase. Subscription fees are:

• Billed in advance on a monthly basis
• Non-refundable except as described in our refund policy
• Subject to change with 30 days' notice
• Automatically renewed unless canceled

Payment Processing

All payments are processed securely through Stripe. We do not store your complete credit card information on our servers. By providing payment information, you authorize us to charge the applicable fees to your payment method.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

Refund Policy

We offer a 14-day money-back guarantee. If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase or subscription renewal. To request a refund, contact us at support@factur.me.

Refunds are processed within 5-10 business days to your original payment method. Refunds are not available after the 14-day period.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You will retain access to the Service until the end of your current billing period
• No further charges will be made to your payment method
• Your data will be retained for 30 days after cancellation
• You may export your data before or during this 30-day period

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe the rights of others, including intellectual property rights
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service (except with our permission)
• Resell, sublicense, or redistribute the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove or modify any proprietary notices

User Content and Data

You retain all rights to the data you input into the Service ("User Content"). By using the Service, you grant us a limited license to use, store, and process your User Content solely to provide the Service to you.

You are responsible for:

• The accuracy and legality of your User Content
• Maintaining backups of your User Content
• Ensuring you have rights to all data you upload

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

Intellectual Property

The Service, including all content, features, functionality, software, and design, is owned by Raihan Software LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. This license does not include any right to:

• Modify or copy the Service
• Create derivative works based on the Service
• Use the Service for commercial purposes outside of its intended use

Data Security and Privacy

We implement industry-standard security measures to protect your data. However, no method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

Your use of the Service is also governed by our Privacy Policy, available at /privacy.

Service Availability and Support

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

Customer support is provided via email at support@factur.me during business hours (Monday-Friday, 9 AM - 5 PM EST).

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAIHAN SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Raihan Software LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
